📜 Terms of Service – ELAGANT CHIC (PTY) LTD

Section 1 – Access and Account

By using our Services, you confirm that you are at least the age of majority in your province or country. You agree to provide accurate and complete information when creating an account or making a purchase. You are responsible for safeguarding your account credentials and all activity under your account.

Section 2 – Our Products

Elegant Chic specializes in haircare and personal care products.

  • Products are for external use only.

  • Results may vary depending on hair type, condition, and consistency of use.

  • Product descriptions, packaging, and availability may change without notice.

  • Colors and product appearance may differ slightly due to device settings.

Section 3 – Orders

Placing an order constitutes an offer to purchase. Orders are accepted only once payment is processed and confirmed. We reserve the right to decline or cancel orders at our discretion. Purchases are for personal use only and not for resale.

Section 4 – Prices and Billing

Prices are listed in South African Rand (ZAR) unless otherwise stated. Taxes, shipping, and handling fees are calculated at checkout. Promotions may be subject to separate terms. You agree to provide accurate billing and payment details.

Section 5 – Shipping and Delivery

We ship via:

  • The Courier Guy: R70 door delivery; R150.50 for high‑risk areas.

  • PAXI: Collection points (customer must provide location code and cellphone number).

  • PUDO lockers/kiosks: Customer must provide locker/kiosk location and cellphone number.

  • International Orders: Available via The Courier Guy; customs duties and import fees are the customer’s responsibility.

Delivery times are estimates only. Elegant Chic is not liable for delays caused by carriers, customs, or events beyond our control. Risk of loss passes to the customer once the order is handed to the carrier.

Section 6 – Intellectual Property

All content, branding, product descriptions, and images are the property of Elegant Chic and may not be copied or reproduced without permission.

Section 7 – Optional Tools

Third‑party tools may be offered “as is” without warranties. Use of such tools is at your own risk.

Section 8 – Third‑Party Links

We may provide links to third‑party websites. Elegant Chic is not responsible for their content, policies, or transactions.

Section 9 – Relationship with Shopify

Elegant Chic is powered by Shopify. Purchases are made directly with Elegant Chic. Shopify is not responsible for any sales, products, or services offered.

Section 10 – Privacy Policy

Personal information is collected and processed in accordance with our Privacy Policy and Shopify’s Privacy Policy.

Section 11 – Feedback

By submitting feedback, you grant Elegant Chic a license to use it for improvement and promotion.

Section 12 – Errors and Omissions

We reserve the right to correct errors, inaccuracies, or omissions in product descriptions, pricing, or availability without prior notice.

Section 13 – Prohibited Uses

You may not misuse our Services, including unlawful activity, infringement of intellectual property, harassment, fraud, or attempts to bypass security.

Automated tools or agents must comply with our access rules. Unauthorized use may result in account suspension.

Elegant Chic is not liable for misuse of products, allergic reactions, or results that differ from customer expectations. Customers are responsible for reviewing ingredients prior to use.

You agree to indemnify Elegant Chic against claims arising from misuse of our Services or violation of these Terms.

Section 19 – Severability

If any provision is found unenforceable, the remainder of the Terms remains valid.

Section 20 – Waiver; Entire Agreement

Failure to enforce any provision does not constitute a waiver. These Terms constitute the entire agreement between you and Elegant Chic.

Section 21 – Assignment

You may not assign your rights under these Terms without our consent. Elegant Chic may assign its rights without notice.

Section 22 – Governing Law

These Terms are governed by the laws of South Africa.

Headings are for convenience only and do not affect interpretation.

We may update these Terms at any time. Continued use of our Services constitutes acceptance of changes.
